Terms and Conditions                                                                Effective Date: 1-1-23

These Terms and Conditions ("Agreement") govern your use of the services provided by Stainless Cable Solutions ("Company," "we," "us," or "our"). By accessing or using our services, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, please do not use our services.

 

1.     Payment

All payments for products and services must be made at the time of purchase. We accept various payment methods, including credit cards, debit cards, and bank transfers. If you wish to pay by bank transfer, please notify us prior to payment to remove the credit card fee. By providing your payment information, you confirm that you are authorized to use the selected payment method.

2.     Failure to Pay

Orders will not be processed unless payment is made in full. If payment is not received for any order, we reserve the right to delay processing and shipping of the order. If payment is not received within 48 hours, we will cancel the order and pursue collection of any outstanding amounts. Any payments made on Net 30 terms will incur a 3% monthly fee on the outstanding balance.

3.     Shipping

We provide shipping services to most countries. Orders will generally be manufactured and shipped within 24 working hours following payment confirmation. Shipping and delivery times are estimates and may vary depending on the selected shipping method and destination. You will receive an email with a tracking number for your shipment. It is your responsibility to track packages via the provided email. SCS does not offer tracking support via phone.

4.     Shipping Costs

Shipping costs are calculated at checkout based on the total weight of the order, dimensions, and shipping address. Additional fees may apply for freight, expedited shipping, and international orders. SCS will be billed by our freight company 30 days after the shipment has been received by the customer. The estimated shipping costs on your paid invoice will be deducted from the total amount due. Customers will be billed for any difference in cost. Customers are responsible for all shipping costs.

5.     Returns

You may return products within 30 days of receipt for a full refund, minus restocking fees. All products must be in their original condition and packaging. No refund will be issued if the product is damaged. Custom cable assemblies, posts, or custom-colored railings are not eligible for returns. All sales made through Buycablerail.com are final. 6.     Error in Ordering

While SCS fills out most Adobe Sign documents based on your submitted drawing, it is the customer’s responsibility to review and, if necessary, correct the length of each cable run. Once an order is signed off and billed, no modifications can be made. Custom products are made for your order. SCS is not responsible for customer errors, and no refunds will be issued for mis-measured products, including cables and posts.

7.     Packing

We take great care to securely pack all items to ensure safe delivery. If you receive a package that appears to have missing items or is damaged, please review the packing list and document any missing items or damage with photographs. You must notify SCS within 48 hours of receipt to facilitate claims. No claims will be accepted after 48 hours.

8.     Warranty

All products are warranted against manufacturing defects for one year. This warranty does not cover damages resulting from misuse, neglect, or normal wear and tear. SCS does not cover warranty claims for products in harsh saltwater environments, including all powder coating and tea staining on stainless cable and hardware. If you believe a product is defective, please contact us for further assistance.

9.     Engineering

Any engineering services or customizations requested are subject to separate terms and conditions, which will be provided upon request. We reserve the right to decline engineering requests that do not meet our operational standards. Any variation in SCS- engineered products, including anchors, will void all warranties and installation support.

10.  Acceptance of Product

Upon receipt of the product, you acknowledge that it meets your specifications and is free from defects. If you have concerns about the condition of the product, you must notify us within 48 hours.

11.  Authorization to Proceed

By placing an order, you authorize us to process the order as specified. Changes to your estimate after processing may not be possible. Please ensure all cable lengths, hardware counts, and post counts are accurate to confirm the invoice is correct. A signed Adobe Sign document is legally binding and considered an official order.

12.  Ownership of Documents

All documents, designs, and materials created in connection with your order are the sole property of Stainless Cable Solutions unless otherwise agreed upon in writing.

13.  Notice of Claims

Any claims arising from products or services provided must be submitted in writing to Stainless Cable Solutions within 30 days of the event giving rise to the claim. Failure to provide timely notice may result in forfeiture of the claim.

14.  Arbitration

Any disputes arising under this Agreement shall be resolved through binding arbitration in accordance with the rules of [insert arbitration organization, e.g., the American Arbitration Association]. The arbitration shall be conducted in Clackamas, OR, and the arbitrator’s decision shall be final and binding.

15.  Enforceability

If any provision of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16.  Modifications

We reserve the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of any revised terms.
